1- Terms and conditions of Sales:

These terms and conditions apply to all services and products sold by Premium Arms International, whether the contract of sale is concluded directly or through the premiumarms.com website.

They also govern the rights and obligations of the parties in the context of direct sales as well as online sales.

Premium Arms International reserves the exclusive right to modify these terms and conditions without notice or delay. Any modification will be updated and published on the website as well as on electronic or printed order forms. The sales contracts concluded are governed by the general conditions published on the date of the conclusion of the sale.

2- Acceptance of these conditions:

The customer acknowledges having read these terms and conditions of sales and understands by the confirmation of his order their irrevocable and unreserved acceptance.

The premiumarms.com and premiumarms.fr websites are the property of SAS Premium Arms International and will be referred to herein as an online catalog or online store.

3- Advertised prices:

The advertised prices are in euros and include all taxes, excluding shipping and transport costs.

Premium Arms International reserves the exclusive right to modify without notice the prices displayed in its online catalog.

The sales contracts concluded are governed by the prices displayed on the date of the conclusion of the sale.

The prices agreed for sales involving new imports are strictly indicative, indexed to the currency exchange rate on the date of the conclusion of the sale and are exclusive of postage, transport costs, customs duties and all costs related to customs clearance. The final prices will be calculated only upon receipt of the goods and will include on the final invoice the shipping and transportation costs, customs duties, and related customs clearance costs.

4- Conditions of sale in France:

The sale of products subject to firearm and weapon regulations in the Premium Arms catalog is strictly reserved for:

4-1 Professional retailers:

Holding an authorization to trade in weapons and firearms, components and ammunition of categories A1, B, C and D and having an SIA number.

4-2 Adult Individuals:

Having:

4-2.1 For Category C:

-Valid Identity card. (Photocopy)

AND

-A valid shooting license stamped by the doctor, issued by one of the 3 authorized French federations. (Photocopy)

OR

-Hunting permit accompanied by the validation of the current or the previous year. (Photocopy)

OR

- Valid collector's card accompanied by a medical certificate in a closed envelope.

4-2.2 For Category B:

-A valid identity card. (Photocopy)

-A valid shooting License, stamped by the doctor, issued by the French Shooting Federation (FFT), (Photocopy)

-the 2 original sections of the valid prefectural authorization for the acquisition and possession of a firearm, having less than six months from its date of issue.

In case of doubt about the destination address, Premium Arms Int may require proof of address.

5- Conditions of Sale abroad:

Refer to the laws and regulations governing the concerned country.

Premium Arms Int undertakes at its own expense the procedures for obtaining permits and authorizations for the export (out of E.C) and transfer (Within E.C) of firearms, components, and ammunition.

Professional clients undertake at their own expense and responsibility for obtaining permits and authorizations for imports (Out of E.C) and introductions (Within E.C) of firearms, components, and ammunition.

6- Conclusion of the sales contract:

The sales contract is deemed to be concluded and final only after acceptance and written confirmation from Premium Arms International by regular mail or email.

7- Right of withdrawal and cancellation of order:

7-1 For the professional client:

Having confirmed their order on the online store or with one of our sales representatives by signing an ordering form, no right of withdrawal applies to online sales or direct sales between professionals.

Any order validated by both parties will not be taken back and exchanged unless accepted in writing by Premium Arms International.

If the goods delivered do not correspond to the initial order due to an error or a defect presented by the product, Premium Arms Int will bear the cost of return, replacement, and re-shipment of the order.

In the event of an order for items not available in stock, Premium Arms Int will inform the customer of the delivery times announced by the supplier or more generally the manufacturer and will in no case be held responsible for any delay caused by the supplier, manufacturer or due to force majeure (strike, riot, war, bad weather, pandemic, unavailability of transport, with no limitation of this list).

Delays in deliveries arising from the supplier, manufacturer or due to force majeure do not in any way constitute a legitimate and valid reason for breaking the sales contract and do not give rise to any right to claim damages from Premium Arms Int.

The professional customer who has paid a deposit for an order and wishing to have it canceled after supplying Premium Arms Int with the items ordered, remains liable for the full amount constituting the sales contract.

Only the non-compliance of an item with the descriptions set out in the online catalog can lead to the outright cancellation of the sales contract concluded and entitles the holder to a partial or total refund of the order.

7-2 For the adult private customer:

7-2.1 Having validated his order online:

If the private customer has validated an order directly on the online store of a standard product (not governed by the regulations on firearms and weapons and not requiring any administrative procedure), a right of withdrawal applies for 14 days from the date of receipt of the order.

Return shipments are the responsibility of the customer and must be carried out in accordance with the rules, namely:

The products must be contained in over-packaging designed specifically for their protection during transport. Since the manufacturer's packaging is not intended for this purpose, it is not sufficient on its own.

Any product shipped in the manufacturer's packaging alone will be systematically refused and will remain non-refundable and non-exchangeable.

The over-packaging must imperatively be neutral and anonymous. Only the following contact details should appear on the package:

Any mention of firearms, parts of firearms or ammunition visible on the packaging is against the law and increases the risk of theft during shipments.

Returns of category B products, in addition to the previously mentioned packaging conditions, must imperatively and in accordance with the law be made in two separate packages, the shipment of which must be separated by at least 24 hours.

Products received in returns that are not in the exact original condition, showing traces of use, torn, damaged packaging, accessories or manufacturer's documentation missing from the original condition and rendering impossible resale will be systematically refused and will not be exchanged or refunded.

In the event of a simple refund or exchange request, the return costs remain the responsibility of the customer.

The risks associated with returning the product, whatever the cause, lie with the customer. If the returned products do not reach Premium Arms Int, the customer will not be able to receive a refund or credit. The same applies if the products return damaged.

It is the customer's responsibility to take out the necessary transport insurance to guarantee their purchase value.

For products accepted for returns, the price of the product will be refunded in full within a maximum period of 14 days.

For category B and C weapon returns, involving seizure and processing of administrative documents, the customer does not have the right of withdrawal provided for by Articles L121-20 of the Consumer Code. However, if Premium Arms Int agrees to the cancellation of the sale, administrative costs related to transactions and guns declarations will be deducted from the total amount of the sale, namely € 125 excluding VAT for items in category C and € 250 excluding VAT for category B items.

In the case of an order made specially at the customer's request involving a partial or total modification, a specific order for the customer, partial or total customization, the right of withdrawal does not apply.

No exchange or refund will be due or granted by Premium Arms Int.

In the event of a withdrawal from the private customer having validated and paid a deposit for an order involving a partial or total modification, a specific order for the customer, a partial or total customization, the total amount of the sale remains due by the customer.

Any late payment of the balance gives rise to the right to late payment penalties in accordance with the terms provided for by the Commercial Code.

However, the private customer wishing to withdraw in the above-mentioned case may, after having paid the full amount of the sales contract, entrust his item for sale on consignment with Premium Arms Int.

After acceptance of the latter, the sum corresponding to the agreed selling price will be returned to the customer after the final sale of the item and its full collection by Premium Arms Int.

8- Order processing:

Orders are processed according to their order of receipt and within the limits of available stocks.

Premium Arms Int strives to guarantee the available stock of each item offered on its online catalog. However, it is possible that the supplier or the manufacturer takes delay in the delivery of restocking and induces the shortage of stock of certain products.

In the event of any stock shortages, Premium Arms Int cannot be held liable to a customer or a third party for any direct or indirect damage or any loss of profit or turnover caused.

9- Payment:

The price invoiced to the customer is that indicated on the order confirmation sent by Premium Arms Int.

Payment for products and services invoiced is made by means of cards, checks or bank transfers. Cash payments are not accepted.

Payment for orders for items available in stock for both private and professional customers is made when ordering unless prior written consent may set other terms. Payment facilities are granted on a case-by-case basis and their acceptance is the sole responsibility of Premium Arms Int.

Payment for items specifically ordered for both private and professional customers involve 60% of the total amount of the order at the conclusion of the sales contract and 40% of the balance before final shipment of the goods to the customer.

No order will be shipped without receipt of full payment.

The customer who has not settled his order remains liable for the total amount thereof.

Any late payment of the balance gives rise to the right to late payment penalties in accordance with the terms provided for by the Commercial Code.

Premium Arms Int retains exclusive ownership of the product until full payment by the customer.

9-1 Online payment:

Premium Arms Int has set up in collaboration with its financial partners a ‘3 D Secure’ environment involving the encryption of bank data.

The details of the credit card used for the online payment of the order are sent directly to the secure server of our financial partner without going through the server of the Premium Arms Int store. This is the best way to guarantee that the information linked to the card are known only by the banking partner. Thus, the online payment will be deemed valid only after its acceptance by our financial partners. In case of refusal of payment, the order will be automatically canceled, and information will be sent to you by email.

10- Discount granted to professionals:

Discounts for professional retailers or dealers vary depending on the manufacturer, quantities ordered per year as well as the volume of business generated by the customer of Premium Arms Int.

The higher discount rates that may be granted occasionally cannot be used for promotional operations by the reseller to the detriment of other resellers generating less volume of business and benefiting from a lower discount rate.

11- Minimum Advertised Price:

Professional customers who are resellers of Premium Arms Int products or brands undertake without reservation to respect the Minimum Advertised Prices and submit to the written authorization of Premium Arms Int for any promotional or destocking operation, whether occasional or permed.

12- Product Descriptions:

The photos published in the online catalog are not contractual and are mostly provided by the manufacturers. If errors occur, they can in no way engage the responsibility of Premium Arms Int. It is the same for the technical and informative descriptions of the products.

13- Deliveries and Delivery Costs:

The delivery costs are always the responsibility of the customer. Orders must be delivered to the addresses indicated during their validation.

Deliveries do not imply the commissioning, assembly or demonstration of the products ordered.

Deliveries made by post or Colissimo are limited to Metropolitan France and Corsica.

Deliveries outside Metropolitan France and Corsica will be entrusted on a case-by-case basis to a carrier designated in advance. The additional delivery costs will be borne by the customer.

Regarding deliveries abroad, it is the customer's responsibility to pay any taxes and customs duties and to comply with the regulations governing their country of residence.

Under no circumstances can Premium Arms Int be held responsible after having issued and transmitted a shipping notice for any delay or anomaly in delivery due to the carrier or force majeure.

In the event of anomalies (damage, missing items, delays), it is up to the recipient customer to undertake the necessary actions with the carrier. The customer has a legal period of 48 hours to make written reservations including detailed and explicit observations to the carrier. In the event of visible deterioration on the delivered parcel, the customer must imperatively refuse the reception of this one by expressing reservations written directly on the delivery slip.

14- Removal:

Pick-ups of orders from our premises can only be done by appointment.

The customer who has collected his order directly from our premises must check the products before leaving. Failure to issue a reserve on our premises implies irrevocable acceptance that the products were in perfect condition at the time of their removal. The removal of products from our premises involves the transfer of the risk of handling, loading and transport to the customer alone.

15- Legal guarantees:

Premium Arms Int guarantees in accordance with the law the lack of conformity of the products sold as well as the guarantees of hidden defects for a period of two years.

16- Commercial guarantees:

Premium Arms Int is held responsible for the commercial guarantees offered by the manufacturers it represents.

It provides after-sales service and repair or exchange if this solution is required. However, it can neither guarantee a repair or exchange time, nor be held responsible for repair or exchange times imposed by the manufacturers.

Product returns under commercial guarantees remain the responsibility of the customer unless after the return the lack of conformity or the presence of hidden defects is confirmed, the return costs will be reimbursed by Premium Arms Int on presentation of proof documents.

If the product can benefit from the commercial or legal warranty, Premium Arms Int will take the necessary steps with the manufacturer to either have the product repaired or have it replaced if repair proves impossible.

In the event of an improper return, or if the problem with the item is due to normal wear and tear, negligence, for example because of shock, improper maintenance, or improper use, such as improper powder loads or improper ammunition etc. The return will be qualified as non-compliant by our gunsmiths and will be treated as such. Under no circumstances can Premium Arms Int be held responsible if the manufacturer refuses to take over the guarantees for the reasons stated above.

17- Nominative Information:

The collection of personal data by Premium Arms Int is necessary for the processing of sales concluded online.

In accordance with the Data Protection Act of January 6, 1978, the premiumarms.com site has been declared to the CNIL.
